  • Justice Court Rules - Civil

    Civil cases in Justice Court are governed by Rules 500-507 and 508 of Part V of the Rules of Civil Procedure. To the extent of any conflict between Rule 508 and the rest of Part V, Rule 508 applies.

    Eviction Forms

    An eviction case is a lawsuit brought to recover possession of real property under Chapter 24 of the Texas Property Code, often by a landlord against a tenant.  A claim for rent may be joined with an eviction case if the amount of rent due and unpaid is not more than $20,000, excluding statutory interest and court costs but including attorney fees, if any. Eviction cases are governed by Rules 500-507 and 510 of Part V of the Rules of Civil Procedure. To the extent of any conflict between Rule 510 and the rest of Part V, Rule 510 applies.

    Debt Claim Packet

    A debt claim case is a lawsuit brought to recover a debt by an assignee of a claim, a debt collector or collection agency, a financial institution, or a person or entity primarily engaged in the business of lending money at interest.  The claim can be for no more than $20,000, excluding statutory interest and court costs but including attorney fees, if any. Debt claim cases in justice court are governed by Rules 500-507 and 508 of Part V of the Rules of Civil Procedure. To the extent of any conflict between Rule 508 and the rest of Part V, Rule 508 applies.

    Alternate Payment Methods

    Alternatives To Payment of Fines and Costs Code of Criminal Procedure Art. 27.14(b)

    A defendant who is convicted of a criminal offense punishable by fine only maybe entitled to alternative methods of satisfying the judgment against them if they are unable to pay the fine or costs, in whole or in part.  Those alternative methods include:

    • A payment plan, allowing the defendant to make payments toward the fine and costs in designated intervals.  Note that if any amount is paid more than 30 days after the judgment assessing the fine or costs then a $15 time payment fee must be assessed.
    • Disposition of the amount assessed by performing community service.  There are many options that meet the requirements of the law for community service, see Art. 45.049 of the Code of Criminal Procedure for full details.  A defendant is entitled to a minimum of $100 credit for every 8 hours of community service performed.
    • If performing community service imposes an undue hardship, a defendant who is indigent or who lacks sufficient resources to pay maybe entitled to a waiver of the fine and costs, in whole or in part.

    Repair & Remedy Petition

    A repair and remedy case is a lawsuit filed by a residential tenant under Chapter 92, Subchapter B of the Texas Property Code to enforce the landlord's duty to repair or remedy a condition materially affecting the physical health or safety of an ordinary tenant.

    The relief sought can be for no more than $10,000, excluding statutory interest and court costs but including attorney fees, if any. Repair and remedy cases are governed by Rules 500-507 and 509 of Part V of the Rules of Civil Procedure. To the extent of any conflict between Rule 509 and the rest of Part V, Rule 509 applies.

  • Texas Department of Public Safety, Game Wardens with Texas Parks and Wild Life Department, the Atascosa County Sheriff's Department  and Atascosa County Pct. 2 Constables file tickets/citations with the Justice Court. Once citations are received by the court, appearance dates are set, you may appear on or before that date.  Failure to appear will result in a warrant being issued for your arrest. On the appearance day the defendant is furnished with a Plea Sheet, the defendant's options are  GUILTY, NOLO CONTENDERE or Not Guilty.  

    The defendant has a right of a trial by jury and to be represented by an attorney, if they desire. If the defendant desires to plead NOT GUILTY we will provide you with a pre-trial hearing date for a future date.  If the defendant submits payment, but fails to enter a plea, then a plea of NOLO CONTENDERE will automatically be entered for you. The court will not accept payment from a third party without a plea of the defendant.

    • If previously entered a plea of NOT GUILTY and would like to pay the fine instead, you will need to contact the Court.
    • If paying the fine after business hours and have an active warrant on your case, the warrant will not be recalled until the next business day.
    • If the defendant is a juvenile you will not have the ability to pay online will need to come into the office to speak to the judge.
    • If the defendant would like to request Defensive Driving or Deferred Adjudication for the ticket then you will need to contact the Court BEFORE making a payment online.
